Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Hobby Horse Derby (the “Game”), developed and published by Eloquix Solutions LLC (“Eloquix Solutions LLC,” “we,” “us,” or “our”).

By downloading, installing, accessing, or playing the Game, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, access, or use the Game.

1. Eligibility

The Game is intended for users who are 13 years of age or older.

By using the Game, you represent and warrant that:

  • You are at least 13 years old; and
  • If you are under 18 years of age, your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. License to Use

Subject to these Terms, Eloquix Solutions LLC grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to download and use the Game solely for your personal, non-commercial entertainment.

You may not:

  • Copy, reproduce, distribute, or sell the Game
  • Modify or create derivative works
  • Reverse-engineer, decompile, or disassemble the Game except where prohibited by applicable law
  • Remove copyright or proprietary notices
  • Use the Game for commercial purposes without our written permission

All rights not expressly granted remain reserved by Eloquix Solutions LLC.

3. In-App Purchases

The Game currently offers one optional in-app purchase:

Remove Ads — $2.99 USD

This purchase permanently removes advertisements within the Game on the applicable Apple account and supported devices, subject to Apple’s platform functionality.

All purchases are processed exclusively through Apple’s App Store.

  • Prices may change at any time.
  • Purchases are non-refundable except as required by applicable law or Apple’s refund policies.
  • Eligible purchases may be restored using Apple’s Restore Purchases functionality where available.
  • Refund requests must be submitted directly through Apple at: https://reportaproblem.apple.com

We do not collect or store your payment information.

4. Advertisements

The free version of the Game displays advertisements provided by Google AdMob.

Advertisements are displayed after gameplay sessions.

By using the free version of the Game, you acknowledge that advertisements may be displayed.

Purchasing Remove Ads disables advertisements within the Game.

We do not control, endorse, or guarantee any third-party advertisements, products, services, or websites that may appear within advertisements.

5. Intellectual Property

The Game and all associated intellectual property are owned exclusively by Eloquix Solutions LLC.

This includes, but is not limited to:

  • Source code
  • Software
  • Graphics
  • Artwork
  • Characters
  • Animations
  • Audio
  • Music
  • Sound effects
  • Logos
  • Trademarks
  • Trade dress
  • User interface
  • Game mechanics
  • Text
  • Documentation

These materials are protected by United States and international copyright, trademark, and other intellectual property laws.

No ownership rights are transferred to you through your use of the Game.

6. Prohibited Conduct

You agree not to:

  • Cheat or exploit the Game
  • Use bots, macros, scripts, automation, or unauthorized software
  • Hack, modify, or alter gameplay
  • Circumvent in-app purchases
  • Attempt to bypass advertisements
  • Reverse-engineer or decompile the Game except where legally permitted
  • Modify memory or manipulate the Game’s operation
  • Interfere with the Game’s security or functionality
  • Use the Game for any unlawful purpose
  • Violate any applicable law while using the Game

7. Health and Safety

Some individuals may experience discomfort while playing video games.

If you experience dizziness, nausea, headaches, eye strain, repetitive stress injuries, seizures, or any other physical discomfort, discontinue use immediately and consult a physician if necessary.

Individuals with a history of photosensitive epilepsy or seizures should consult a medical professional before playing.

Never play the Game while driving, cycling, operating machinery, or performing any activity requiring your full attention.

8. Updates and Availability

We may update, modify, suspend, discontinue, or remove the Game or any feature at any time without prior notice.

Updates may:

  • Change gameplay
  • Change game difficulty
  • Add or remove features
  • Fix bugs
  • Introduce new content
  • Modify advertisements
  • Affect compatibility with devices or operating systems

We do not guarantee that the Game will remain available indefinitely.

We do not guarantee compatibility with all devices, hardware configurations, or future operating system versions.

9. Disclaimer of Warranties

THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE.”

To the fullest extent permitted by law, Eloquix Solutions LLC disclaims all warranties, express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy
  • Reliability
  • Availability

We do not warrant that:

  • the Game will operate without interruption;
  • the Game will be error-free;
  • defects will be corrected;
  • advertisements will always function properly;
  • the Game will remain available;
  • saved game progress will always be preserved; or
  • the Game will be free from viruses or other harmful components.

Your use of the Game is entirely at your own risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Eloquix Solutions LLC and its owners, officers, employees, contractors, licensors, affiliates, and partners shall not be liable for any:

  • indirect damages;
  • incidental damages;
  • consequential damages;
  • punitive damages;
  • special damages;
  • loss of profits;
  • loss of revenue;
  • loss of business opportunities;
  • loss of data;
  • corruption or loss of saved game progress;
  • interruption of service;
  • device incompatibility;
  • battery usage;
  • software conflicts; or
  • any other damages arising out of or relating to the Game.

Where permitted by law, our total cumulative liability arising out of or relating to the Game shall not exceed the greater of (a) the amount you paid to us for the Game or in-app purchases during the twelve (12) months immediately preceding the claim, or (b) US $2.99.

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

11. Termination

We reserve the right, in our sole discretion, to suspend or terminate your access to the Game at any time, with or without cause and with or without notice.

Upon termination:

  • your license immediately ends;
  • you must cease using the Game; and
  • any provisions intended to survive termination will remain in effect.

12. Arbitration and Class Action Waiver

Please read this section carefully.

To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to the Game or these Terms shall be resolved exclusively through binding individual arbitration, rather than in court.

You and Eloquix Solutions LLC each waive the right to participate in:

  • class actions;
  • class arbitrations;
  • representative proceedings; or
  • jury trials,

except where such waivers are prohibited by applicable law.

Nothing in this section limits either party’s right to seek relief in small claims court where permitted.

13. Force Majeure

Eloquix Solutions LLC shall not be liable for any delay or failure to perform resulting from events beyond our reasonable control, including but not limited to:

  • internet outages;
  • cloud service failures;
  • App Store outages;
  • acts of God;
  • natural disasters;
  • war;
  • terrorism;
  • labor disputes;
  • governmental actions; or
  • failures of third-party service providers.

14. Export Compliance

You agree not to use or export the Game in violation of any applicable United States export control or sanctions laws.

15. Apple App Store Terms

If you obtained the Game through Apple’s App Store:

  • Apple is not responsible for providing maintenance or support services for the Game.
  • Apple is not responsible for addressing claims relating to the Game.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as applicable.

16. Changes to These Terms

We may modify these Terms from time to time.

When changes are made, we will update the Last Updated date at the top of this page.

Your continued use of the Game after revised Terms become effective constitutes your acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the United States and the State of Nevada, without regard to conflict of law principles.

18. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

19. Assignment

Eloquix Solutions LLC may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, sale of assets, or by operation of law.

You may not assign your rights or obligations under these Terms without our prior written consent.

20. Entire Agreement

These Terms constitute the entire agreement between you and Eloquix Solutions LLC regarding your use of the Game and supersede any prior agreements, understandings, or communications relating to the Game.
